ORLANDO— A federal judge has thrown out a discrimination lawsuit by the state attorney general against the Adam’s Mark hotel in Daytona Beach, ruling that the case belongs in state court. U.S. District Judge Ann Conway’s ruling on Nov. 5, cancels a scheduled Nov. 14 federal trial against HBE Corp., parent company for the Adam’s Mark chain. As previously reported by HOTEL BUSINESS®, the planned trial grew out of complaints about how black guests were treated at the hotel during the 1999 Black College Reunion. Adam’s Mark denies all allegations. Conway gave the state 30 days to re-file the lawsuit. Senior assistant attorney general John D.C. Newton II said the state will continue to pursue the case.
